We have worked with MHLCG, Defra and Natural England to answer the questions we are most frequently asked by local authority officers and members about biodiversity net gain and those that have come up at events so far. These questions and answers should be read alongside the Biodiversity net gain Planning Practice Guidance (PPG) and Government guidance pages on BNG.

Government has laid regulations which set in motion changes to Biodiversity Net Gain (BNG) for projects requiring planning permission under the Town and Country Planning Act. Further information on the changes is provided in this Defra blog and the Explanatory Memorandum to the regulations. In summary, the changes that apply to planning applications made on or after 6 August 2026 are:

  • exemption for developments of 0.2 hectare or less;
  • exemption for temporary development;
  • easing of the biodiversity gain hierarchy for minor development; and
  • removal of the existing exemption for self and custom build development.

Until 6 August, the BNG approach remains the same as when initially introduced in Spring 2024 via Schedule 7A (Biodiversity Gain in England) of the Town and Country Planning Act 1990 – see the Biodiversity net gain Planning Practice Guidance (PPG) for further details. 

The government has stated (in the consultation cited above) that BNG is not in scope of the Planning and Infrastructure Act 2025, and the Nature Restoration Fund introduced by the Act is not expected to have any substantive impact on the operation of BNG in practice.
