As we reported in our January 2023 Advisory Bulletin the Department for Business, Energy and Industrial Strategy (BEIS) has consulted on a draft Code of Practice on Dismissal and Re-engagement.
In summary, the draft Code sets out employers’ responsibilities when seeking to change employment terms and conditions, if there is the prospect of dismissal and re-engagement. It requires employers to consult staff and explore alternative options, without using the threat of dismissal to pressure employees to agree new terms.
After seeking views from local authorities the LGA responded to the consultation. On the whole local authorities told us that they broadly supported the draft Code and a copy of our response which reflects those views can be obtained by contacting [email protected]
We now await the Government’s response to the consultation and any relevant developments will be reported in our Advisory Bulletins.
